       Mr. Moshtaq Talib Wahaib has been awarded PhD in the legal sciences – Modern crimes – by University of Szczecin – Faculty of Law and Administration – Republic of Poland. He presented his dissertation titled by:

“Information Forgery as One of the Information Crimes in the Light of the Iraqi Law”

ABSTRACT

Human history has witnessed, through technological evolution, essential changes. This led to increase the interest on information as one of the inputs, connected with our present complex and technological societies. The integration between the information and the technology permits and facilitates the achievement of the daily transactions. Although the benefits introduced by the information technology, it is at the same time a fertile environment presenting opportunities to perpetrate various kinds of unsocial actions.

The emergence of these kinds of acts associated with technology has resulted in the fact that many activities having a criminal nature; whether are old-fashioned crimes such as fraud or new types of crimes such as computer hacking, drastically increased their impact on the society and on the level of individual, collective and financial security. They are called “information crimes”. They have become a source of threat to the international community in relation with various types of crimes: such as: information terrorism, violation of the privacy, fraud, theft and forging information (which is the subject of this dissertation).

The dissertation begins to examine the information crime in general and this is done through defining this phenomenon, its characteristics and categories and criminals perpetrating the crime. The role played by the information and computer technology is also examined in the dissertation. The dissertation studies information forgery as one of this kind of the crimes, because the information forgery threatens the documents, which are an object of the crime, used to prove the legal status of the person. In particular, these documents have been greatly influenced by the technological developments. Accordingly, the main aim of this dissertation is to suggest an effective proposal to the legislator in Iraq for improving legal texts to deal with the information crime. This is done through answering the following questions:

‘May the change of the truth, which is perpetrated against the information documents, be a legally punished crime?’,

‘May the current texts of Iraqi Penal Code be enough to criminalize this action, or this requires adopting new legislations that are able to address this action?’
